Dear Cybele Roberts Emmanuel:

Assistant Secretary Larry Irving forwarded your e-mail about Network Solutions and the domain name "AOLSearch" to me. While we do not, under guidance provided by the United States Office of Management and Budget, resolve disputes between individuals and Network Solutions, NTIA will make an inquiry on your behalf.

The Network Solutions' dispute policy permits them to put a domain name registration "on hold" when they receive a complaint from a registered trademark holder that their trademark is being infringed.

I suspect that America Online has registered AOL as a trademark, and that a complaint from America Online is the basis for Network Solutions' actions.

I can not, of course, give you legal advice about the strength of America Online's trademark claim.

But you may want to contact America Online directly to see if some practical accomodation can be arranged. In the meanwhile, as I indicated, we will ask Network Solutions for an explanation of the circumstances under which this transfer was made.

Mr. Roberts, I conducted a "Whois" search of the domain in question and see that it was created

on 22 Jun 98. Can you prove that it was previously registered to you?

Do you have documentation (email with a tracking number from NSI, billing invoice, receipts) to substantiate your claim? If you can provide enough information to prove that NSI wrongly redirected the resolution name servers then get an attorney and file suite. If you have already spoken to NSI officials and they do not want to take responsibility for their actions then you have no other recourse. I can not do anything to assist you in this matter.

My responsibility lies with the management and administration of the .GOV domain used for registrations of the Federal, State, and Local Governments.
